Rules and Regulations

 

 

“Kaise Badlegi Poorva ki Zindagi Contest” (“Contest”) will be held by Star Plus (“Channel”) on www.starplus.in /microsite:badlegizindagi.starplus.in as stated hereunder:

 

PRINCIPAL TERMS

 

  1. The Contest will be held from February 3, 2010, 00:00 hrs (IST) and shall conclude on February 10, 2010, at 23:59 hrs (IST) (“Period”).

 

2.   The viewer(s) interested in participating and qualifying for the Contest can register their response/answer to one question related to the show ‘Behenein’ by logging onto website www.starplus.in /microsite:badlegizindagi.starplus.in (“Website”) and submitting their email ID.

 

  1. Contestants who have registered correct response/answer to the question will qualify for the Contest.

 

  1. Contestants should state all the required information, which has been asked from them.

 

  1. The contestants should register their response/answer to the question anytime during the Period mentioned above. Response/answers registered after the Period shall not be considered for the Contest and shall be null and void.

 

6.   At the end of the Period, one (1) winner will be selected by a process of random selection from amongst the contestants who have answered the question correctly (“Winner”).

 

7.      The Winner shall be informed/contacted by Channel within seven (7) days from the end of Period.

8.   The winner shall win a chance to meet and interact with a STAR Plus celebrity in Mumbai (“Prize”).

 

9.      Within thirty (30) days from announcement of the Winner, Channel shall make arrangements of the interaction with the celebrity and bear the cost of the interaction.

 

10.  The Winner shall have to make his/her own arrangements for travel to and from the place of interaction with the celebrity.

 

11.  The date, time and place of interaction shall be conveyed to the Winner by the Channel as per the availability of the celebrity.

 

12.  In the event, the Winner fails to make himself available on the date, time and place of interaction with the celebrity and avail the Prize, for reasons whatsoever, the Winner’s right to the Prize shall be forfeited.

 

13.  By participating in the Contest(s), it shall be construed by STAR India and / or Channel that the contestant(s) has prior to participating in the Contest, read and understood all the rules and regulations of the Contest on www.starplus.in  and has agreed to abide to the same.

 

14.  By participating in the Contest(s), it shall be construed by STAR India and / or Channel that the Winner has waived his/her right to raise any dispute with regard to the Contest and/or in any manner whatsoever in connection to the Prize.

 

General Rules

 

1.   The contestant(s) should be citizens of India, residing in India and above 18 years of age to qualify for the Contest.

 

2.   The contestant(s) should not have criminal conviction or an arrangement or a contract that prevents the contestant(s) from participating in the Contest..

 

3.   Proof of age is a must for the contestant(s) and must be submitted to the Channel/ STAR India Pvt Ltd (“STAR INDIA”) (i.e., Birth Certificate, 10th Class leaving Certificate/ School certificate/ passport/ an affidavit signed by a magistrate).

 

4.   The Channel/STAR INDIA reserves all rights to make amendments to the existing rules without prior notice.  

 

5.   Non-conformance by any contestant(s) of the rules of the Contest will disqualify them from participation immediately, as the case may be.

 

6.   The Winner of the Contest agrees that he/she shall make himself/herself available from time to time and co-operate with the Channel and/or STAR India and participate in any activity and/or campaign (“Promotional Activity”) of any nature whatsoever without any money payable to the Winner.  Further, the Winner shall at no point of time refuse or disagree to participate in any such Promotional Activity for any reason whatsoever. The Winner agrees that the footage of any nature with regard to the Winner shall vest with STAR India, including but not limited to all intellectual property rights and any other rights for worldwide and in perpetuity.  

 

7.   By participating in the Contest, it shall be construed that the Winner has given his/her consent to STAR India and/or the Channel and/or their film crew to film the meeting between the Winner and the artist of the Program and also agree to this footage being used in the Program and/or any other program for broadcast or in any other manner as deem fit by STAR India and/or the Channel. The intellectual property rights in and/or the footage shall vest in entirely in favour of STAR India, world-wide and in perpetuity, in any and all media, by and/or any medium, technology whatsoever without any money payable to me.

 

8.   The contestant(s) cannot exchange the Prize for an item or cash equivalent. If the Winner refuses to accept the Prize awarded, the Channel and/or STAR India and its affiliates shall be released from all obligations towards the Winner in connection to the Prize won by the Winner. Further, after forfeiting the Prize, STAR India and/or the Channel shall be entitled to randomly select and declare another Winner, as it deems fit, and award the Prize, to that Winner. 

 

9.   By participating in the Contest, it shall be deemed to be construed that the contestant(s)/Winner has waived his/her right to raise a dispute in connection to the Prize so awarded to the contestant(s) upon winning the Contest. If the Winner is not satisfied with the artist that is proposed to visit the Winner, the Channel and/or STAR India and its affiliates shall be released from all obligations towards the Winner in connection to the Prize won by the Winner.

 

10. By participating in the Contest, it shall be construed that the Winner of the Contest has agreed that the Winner shall, at all times, hold harmless the Channel, STAR India, its affiliates its employees, officers or any other person in relation to any injury/damage/harm/loss suffered by him/her in any manner, whatsoever, in connection with the Prize and that the Winner shall also not file in person and/or through any family member and/or third party any applications, criminal and/or civil proceedings in any courts or forum in India the Channel and/or STAR India and its affiliates to claim any damages or reliefs or otherwise.

 

11. The Winner agrees that if due to any reason, whatsoever, beyond the control of the Channel and/or STAR India, the Prize and/or anything in connection to the Prize and/or the enjoyment of the Prize becomes ineffective or invalid, the Channel and/or STAR India and its affiliates cannot be held responsible for the same.

 

12. The contestant(s agrees that he/she shall hold harmless the Channel, STAR INDIA, its employees, officers or any other person in relation to any injury/damage/harm/loss suffered by him/her, in any manner, whatsoever in connection with the Activity and shall also not file in person/ through any family member and/or third party any applications, criminal and/or civil proceedings in any courts or forum in India against the Channel and/or STAR INDIA to claim any damages or relief’s or otherwise.

 

13. The Channel and/or STAR INDIA reserves the right to withdraw the Contest at any time without giving any prior notice thereof to the contestants and /or otherwise

 

14. The Channel and/or STAR INDIA is in no manner whatsoever responsible and/or shall not be held liable in any manner whatsoever, for any injury, death, mental trauma caused to the contestant(s) in any manner whatsoever, in connection to the Contest and/or otherwise.

 

15. Employees of the Channel, STAR INDIA, and the members of their immediate family, persons with criminal convictions, persons other than citizens of India, are ineligible to participate and be part of the Contest.

 

16. STAR India and/or the Channel reserve the right to forfeit the Prize in the event it is found by STAR India and/or the Channel that any information provided by the contestant(s) or the Winner is wrong or any misrepresentation is made by the contestant(s) or the Winner. STAR India or the Channel shall have the right to declare another contestant(s) as the Winner(s) of the Contest and transfer the Prize to that person. 

 

17. All contestant(s), the Winner, shall do any and all acts and execute any and all documents in such manner and at such location as may be required by the Channel and/or STAR India in its sole discretion to protect, perfect or enforce any of the rights granted or confirmed to STAR India and/or the Channel herein.

 

18. The rules and regulations of this Contest  shall be construed in accordance with the laws of India and incase of any dispute or other matter arising in reference to the Activity shall be referred to a sole arbitrator appointed by STAR INDIA and shall be governed by the Arbitration and Conciliation Act, 1996, amended from time to time. The venue for arbitration shall be Mumbai, in English language. All the costs, charges and expenses in connection to the Arbitration shall be solely borne by the contestant(s) and or Winner who has raised the dispute.

 

19. Subject to rule 18, only the courts in Mumbai shall have the sole and exclusive jurisdiction to decide on any dispute relating to the Contest.
